August 19, 2026 — A federal judge in Texas, Chief U.S. District Judge Reed O'Connor, ruled on Monday, August 17, 2026 that the ATF's 2022 "frame or receiver" rule targeting ghost guns is unconstitutional. He found it violates the right to keep and bear arms under the Second Amendment and is too vague to satisfy the Fifth Amendment's due process guarantees.
How We Got Here
- The rule (finalized in 2022) required that unfinished frames/receivers and kits (like those sold by Polymer80) be treated as regulated firearms, requiring serial numbers, background checks, and dealer records.
- The case is Defense Distributed's challenge, and O'Connor is a George W. Bush appointee. He had actually struck the rule down once before. The Supreme Court overturned that earlier ruling in March 2025 (7-2), but on statutory grounds — whether ATF exceeded its authority under the Gun Control Act — not on constitutional grounds.
- This new ruling revisits the case on the constitutional questions the Supreme Court didn't address, and finds the rule fails there.
- Many folks on both sides of the dynamic expect DOJ to appeal. DOJ, which has defended the rule in court even under the Trump administration, hadn't responded to requests for comment as of the story's publication. So this is very likely headed for appeal (to the Fifth Circuit, and possibly back to the Supreme Court), and the rule's ultimate fate isn't settled yet.
