Appeals to the NFA Injunction?

August 19, 2026 — There is a lot of talk about the NFA Injunction within firearm circles, FFL businesses, and online. U.S. District Judge James Wesley Hendrix presented an Opinion to the Court on August 5, 2026. He ruled that major NFA registration and requirements are unconstitutional. As many know, the Opinion called for a 7-day stay of the effects of the ruling, which expired on August 13, 2026.

Following the expiration, a lot of activity has begun. The Texas State Rifle Association is a named plaintiff in the Jensen lawsuit. Judge Hendrix's ruling applied to TSRA as a result. What Judge Hendrix's opinion did not stop, however, is the ongoing potential for appeals. Although his ruling included the 7-day stay, a larger appeal window remains. There is an automatic 60-day Justice Department appeal window. This means the DOJ can issue an appeal on this matter any time within those 60 days.

The ruling has not received official guidance from the ATF or the Department of Justice. This guidance would provide covered dealers and purchasers with information for transactions under the injunction. You may find that many FFLs are not risking their license at this time, due to the lack of this guidance.
