TSRA and NRA File NFA Lawsuit
A Complaint has been filed in the Amarillo District Court against the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), Daniel P. Driscoll (as Acting Director of the ATF), the United States Department of Justice, and Pamela J. Bondi (as Attorney General of the United States). While President Trump’s One Big Beautiful Bill eliminated the making and transfer taxes on suppressors, short-barreled rifles, short-barreled shotguns, and NFA-defined “any other weapons,” it left the invasive and unconstitutional registration requirements intact. This suit seeks to remedy that, calling for a judgment to declare the NFA as unconstitutional due to the continued regulation of untaxed items.
TSRA was originally approached by the NRA Institute for Legislative Action (NRA-ILA) to aid in securing plaintiffs for this suit, but through meetings, research, and consideration for TSRA Members, it was decided to join as an organizational plaintiff. Together with three individual plaintiffs and three other organizational plaintiffs, TSRA is now named in this case. We are dedicating our time and information to this matter on behalf of our thousands of members, our long-standing organization, and all law-abiding Texans.
This case is not expected to be short, but effective. The NRA filed its first suit in Missouri, and the Texas case is the second. The case is expected to move to the 5th Circuit Court of Appeals, and then to the Supreme Court. It is hoped that it will conclude during the current term of President Trump, but there is no telling how long the legal process will take to reach a resolution.
