Ken Paxton Goes to Supreme Court Over State Fair

The Appeal filed by Attorney General Ken Paxton in the 15th Court of Appeals was denied on Tuesday.

The Defendants, the City of Dallas, Kimberly Bizor Tolbert (Interim City Manager for the City of Dallas) and the State Fair of Texas had until noon on Tuesday to submit their responses to the AG’s Appeal. They filed those responses just in time, at 11:56 a.m., and 11:57 a.m. that morning. That afternoon, the Court issued the Order in which they denied the AG’s Appeal.

The denial and the opening of the Fair tomorrow have not stopped Attorney General Paxton’s efforts. On Wednesday, he shared an update through a Press Release on his website and social media, in which he announced he has filed a Petition for Writ of Mandamus in the Texas Supreme Court.

A Writ of Mandamus is known as an extraordinary remedy that can be used to challenge an order. If successful, the Petition would grant the State’s request for emergency relief just in time.
